When you place an order, you are making an offer to purchase. KY PICK reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until KY PICK confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as KY PICK may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made. Your purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK]. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers,  customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by KY PICK.  KY PICK's names, logos, product and service names, designs, and slogans are trademarks of KY PICK or its affiliates or licensors. You must not use such trademarks without the prior written permission of KY PICK. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners. 

SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. KY PICK  is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with KY PICK. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and KY PICK, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with KY PICK.

You agree to indemnify, defend and hold harmless KY PICK , Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services. We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). 주문을 제출하는 것은 구매 의사 표현이며, KY PICK은 단독 재량으로 주문을 승인 또는 거절할 수 있습니다. 결제가 접수·처리된 후 주문이 최종 승인됩니다. 주문 제출 후 취소 요청은 승인되지 않을 수 있습니다. 주문이 승인되지 않거나 변경 또는 취소되는 경우, 주문 시 제공한 이메일·청구 주소·전화번호로 연락 드립니다. 환불·교환은 당사의 환불정책[LINK]에 따릅니다.
고객은 모든 구매가 개인적 또는 가정용이며, 재판매·수출 목적이 아님을 보증합니다.

당사는 언제든지 서비스 제공을 중단하거나 고객의 접근을 철회할 수 있습니다. 종료 후에도 지식재산권, 면책, 책임 제한, 준거법 등 일부 조항은 계속 유효합니다.

SECTION 15 – 보증 부인

서비스의 모든 정보와 제품은 “있는 그대로” 제공됩니다. 당사는 정확성, 안정성, 무오류를 보장하지 않으며, 특정 목적에의 적합성 등 모든 묵시적 보증을 부인합니다. 일부 지역에서는 이러한 책임 제한이 허용되지 않을 수 있습니다.

SECTION 16 – 책임 제한

법이 허용하는 최대 범위 내에서, 당사는 서비스 사용으로 인해 발생하는 직접·간접·특별·부수적 손해에 대해 책임을 지지 않습니다. 영업 손실, 데이터 손실, 교체 비용 등 모든 손해에 대해 면책됩니다.

SECTION 17 – 면책

고객이 약관 위반, 법 위반, 서비스 오용으로 인해 발생한 제3자 청구에 대해 KY PICK 및 Shopify에 손해가 발생하면, 고객은 이를 보상할 책임을 집니다.

SECTION 18 – 분리가능성

약관 중 일부가 무효가 되더라도 나머지 조항은 계속 유효합니다.

SECTION 19 – 전체 합의

본 약관은 서비스 이용에 관한 전체 합의이며, 이전의 모든 구두·서면 합의를 대체합니다.

SECTION 20 – 양도

고객은 본 약관상의 권리·의무를 타인에게 이전할 수 없습니다. 반면, KY PICK은 사전 통보 없이 약관을 양도할 수 있습니다.

SECTION 21 – 준거법

본 약관은 KY PICK 본사가 위치한 지역의 법률 및 관할 법원의 적용을 받습니다.

표제(Section 제목)는 편의를 위한 것이며 조항 해석에 영향을 미치지 않습니다.

SECTION 23 – 약관 변경

최신 이용약관은 이 페이지에서 확인할 수 있습니다. 중대한 변경 사항은 법에 따라 고지되며, 고지된 날짜에 효력이 발생합니다. 변경 후 서비스 이용 시 변경된 약관에 동의한 것으로 간주됩니다.
